DocMarked provides an electronic signature platform that allows users to:

• Track document status and signing history

3. Account Registration and Security

To use DocMarked, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or the age of majority in your jurisdiction
• Notify us immediately of any unauthorized account access

You are responsible for all activities that occur under your account.

4. Electronic Signatures

You acknowledge that electronic signatures created through DocMarked have the same legal effect as handwritten signatures under the Electronic Signatures in Global and National Commerce Act (ESIGN Act) and applicable state laws.

By electronically signing a document, you certify that you are the person whose signature appears on the document and you intend to be legally bound by the terms of that document.

5. User Responsibilities

You agree to:

• Use the service only for lawful purposes
• Not upload malicious software or harmful content
• Not impersonate another person or entity
• Not interfere with the operation of the service
• Maintain accurate contact information
• Comply with all applicable laws and regulations

6. Intellectual Property

DocMarked retains all rights, title, and interest in the platform, including all intellectual property rights. You retain ownership of your documents and content.

By uploading documents to DocMarked, you grant us a limited license to process, store, and transmit your documents as necessary to provide the service.

Your use of DocMarked is subject to our Privacy Policy. We collect, use, and protect your data as described in our Privacy Policy.

8. Subscription and Payment

Paid plans are billed in advance on a recurring basis. You agree to:

• Provide accurate billing information
• Pay all fees when due
• Allow automatic renewal unless cancelled

We reserve the right to change pricing with 30 days' notice. Refunds are provided according to our refund policy.

9. Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Your payment fails
• Required by law

You may cancel your account at any time from your account settings. Upon termination, your access to signed documents will be retained for the legally required retention period.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCMARKED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold DocMarked harmless from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or platform notification. Continued use of the service after changes constitutes acceptance of the new Terms.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions.
